EXCLUSIVE RIGHTS IN SOUND RECORDINGS
The specific rights
granted under copyright law to the copyright owner, or his licensee,
with respect to sound recordings (not to include audiovisual recordings
or motion pictures). These rights include:
1) Reproduction rights,
2) Distribution rights, and
3) Derivative work rights.
Reproduction rights and distribution rights
combined are called "publishing rights." However, by
law, these rights are divisible.
Derivative work rights are limited to derivative
works of the actual sounds that are fixed in the sound recording.
This means that the copyright owner in a sound recording has the
right to remix, rearrange, or alter in sequence or quality the
sounds already recorded. This right does not disallow the production,
by another party, of a sound-alike recording that is an independent
